Terms of Service

1. Purpose and acceptance
These terms and conditions (the « Terms ») govern access to and use of the idem0 service (the « Service »), published by idem0, 60 Rue François 1er, 75008 Paris, France (« idem0 », « we »).
By creating an account or using the Service, you (the « User ») accept these Terms without reservation. If you use the Service on behalf of an entity, you warrant that you are authorized to bind it.
2. Description of the Service
idem0 is a technical service (proxy) that sits between your application and AI model providers (Anthropic, OpenAI). It adds an idempotency guarantee: when an identical request is sent multiple times, idem0 returns the original response rather than re-executing it against the provider.
idem0 does not provide the AI models themselves and is affiliated with neither Anthropic nor OpenAI.
3. BYOK model — your provider keys and costs
The Service operates on a « BYOK » (Bring Your Own Key) basis: you use your own API keys with the model providers. Consequently:
- You are solely responsible for obtaining, validating, and securing your provider keys.
- The costs of using the AI models are billed directly by the providers (Anthropic, OpenAI) and are your sole responsibility. idem0 bills only for its own service (idempotency), excluding any model costs.
- idem0 does not retain, store, or log your provider keys, which pass through only to be forwarded to the provider.
4. Account and access
Access to the Service requires creating an account. You are responsible for the confidentiality of your credentials and your idem0 API keys, and for any activity carried out from your account. You undertake to provide accurate information.
5. Plans and pricing
The Service is offered under several plans, including a free plan and paid monthly-subscription plans, described on the pricing page. The applicable prices are those displayed on the site at the time of subscription.
Payments are processed by our provider Stripe. You warrant that you hold the necessary rights over the payment method used.
6. Subscription, renewal, and cancellation
Paid subscriptions are entered into for a monthly term, automatically renewed by tacit renewal.
You may cancel your subscription at any time from your account. Cancellation takes effect at the end of the current billing period. No refund, in whole or in part, is due for a period already begun.
idem0 reserves the right to modify its prices, subject to prior notice, with new prices applying at the next renewal.
7. Acceptable use
You undertake not to use the Service for:
- any illegal or fraudulent activity, or any activity infringing the rights of third parties;
- circumventing, altering, or compromising the operation or security of the Service;
- reselling, redistributing, or providing access to the Service to third parties without authorization;
- transmitting manifestly unlawful content through your requests.
Compliance with the terms of use of the model providers (Anthropic, OpenAI) is your responsibility.
8. Service availability
The Service is provided « as is » and « as available ». idem0 does not warrant that the Service will operate uninterrupted, error-free, or without defect. idem0 endeavors to ensure reasonable availability but provides no service-level agreement (SLA) under these Terms.
idem0 may temporarily suspend the Service for maintenance or security reasons.
9. Limitation of liability
To the extent permitted by law:
- The Service is provided without warranty of fitness for a particular purpose. idem0 shall not be liable for the decisions or processing you base on the responses transmitted by the Service.
- idem0 is not liable for indirect damages, including loss of data, loss of business, loss of revenue, or model costs billed by the providers.
- In any event, idem0’s total liability under these Terms is limited to the amounts you have actually paid to it during the twelve (12) months preceding the triggering event.
These limitations do not apply in the event of gross negligence or willful misconduct, nor where the law prohibits such limitation.
10. Intellectual property
idem0 (the trademark, the website, the interface, the service) remains the property of its publisher. The « @idem0/sdk » software development kit is made available as open source under the MIT License.
You retain full rights to the content of your requests and to the responses you obtain.
11. Personal data
The processing of personal data is described in the Privacy Policy, which forms an integral part of these Terms.
12. Suspension and termination by idem0
idem0 may suspend or terminate your access in the event of a breach of these Terms, in particular non-compliant use under section 7, where appropriate without notice if the severity warrants it.
13. Changes to the Terms
idem0 may modify these Terms. Users will be informed of substantial changes. Continued use of the Service constitutes acceptance of the modified Terms.
14. Governing law and jurisdiction
These Terms are governed by French law. Any dispute relating to their validity, interpretation, or performance falls under the jurisdiction of the French courts, subject to applicable mandatory rules.
